Banking Licence Requirements in Mauritius: Capital, Compliance, and Regulatory Obligations

The principal requirements for obtaining and maintaining a banking licence in Mauritius under the Banking Act 2004, including minimum capital, liquid assets, and regulatory compliance.

The Banking Act 2004 establishes the regulatory framework for banking institutions in Mauritius. The Bank of Mauritius is responsible for the licensing, supervision, and regulation of banks.

Licensing

Section 7 of the Banking Act 2004 provides that no person shall carry on banking business in Mauritius without a licence granted by the Bank of Mauritius. An applicant must satisfy the Bank that it is a fit and proper person, that it has adequate capital, and that its affairs will be managed in a prudent manner.

Minimum Capital Requirements

Section 20 of the Banking Act 2004 prescribes minimum capital requirements for banks. A bank must maintain a minimum paid-up capital as determined by the Bank of Mauritius. The Bank may prescribe different capital requirements for different categories of banks.

Liquid Assets

Section 22 of the Banking Act 2004 requires banks to maintain adequate liquid assets. The Bank of Mauritius prescribes the minimum liquidity ratio that banks must maintain at all times. Liquid assets include cash, balances with the Bank of Mauritius, and government securities.

Restrictions on Dividends

Section 27 of the Banking Act 2004 restricts the payment of dividends. No bank shall declare, credit, or pay any dividend until the Bank of Mauritius is satisfied that the payment of dividend is prudent having regard to the bank's financial condition, capital adequacy, and liquidity position.

Confidentiality

Section 64 of the Banking Act 2004 imposes a duty of confidentiality on banks. A bank shall not disclose to any person any information relating to the affairs of a customer, subject to certain exceptions prescribed by the Act.
